CONCEPT

Floor clauses are usually included in many mortgages. In accordance with the Sentence of the Court of Justice of the European Union of December 21, 2016, banking entities must return the amounts paid in excess by reason of this clause from the date of formalization of the mortgage. In addition to these floor clauses there are many others considered abusive by the Courts of Justice.

EVOLUTION

During 2007 and 2008, many entities placed floor clauses on mortgages, without warning customers of their economic consequences. This lack of transparency in the marketing of products with this type of clause has led the courts to declare its abusivity, forcing the banks to return all the money. If your mortgage was signed between 2001 and 2012 and the amount of your installment has not decreased by the equivalent of Euribor, you will almost certainly have floor clauses.
